Terms and Conditions

1. Managed Hosting and SaaS Model

1.1 Unless expressly stated otherwise, all websites designed and hosted by Imajique operate under a Software-as-a-Service (SaaS) model, referred to as “Managed Hosting.”

1.2 Under this model, Imajique retains control of the website’s backend code and functionality. Sites will only operate on Imajique’s servers. Customers may not run or host the site independently.

1.3 While the customer retains intellectual property rights for logos, text, images, and other content provided to Imajique, all coding, backend logic, and proprietary functionality remain the property of Imajique.

1.4 Customers are granted a non-exclusive, non-transferable license to use the SaaS website for their own purposes while it is hosted by Imajique.

2. Static Site Provision

2.1 If the customer cancels services, Imajique may provide a static version of the website upon request. This service incurs a fee starting at AUD 1000, depending on the size and complexity of the website.

2.2 Static sites will not include backend functionality or dynamic features. Any functionality dependent on Imajique’s proprietary code will be lost.

3. Content Management & Editing

3.1 SaaS-hosted sites do not permit customers to edit or modify the back-end code or front-end structure or content of their website.

3.2 Customers may have access to blog or content sections for editing only where explicitly provided.

4. Fees and Charges

4.1 Annual hosting fees are non-refundable, regardless of service cancellation.

4.2 Requests for domain transfer incur an administration fee of A$120.

4.3 Requests for a static site export will incur a minimum fee of A$360, depending on the size and complexity of the website.

4.4 Payment for all work must be made via approved quote and invoice prior to commencement of work.

5. Payment and Work Commencement

5.1 Work begins only after full payment is received.

5.2 No credit is extended, and no work will start without prior payment.

5.3 Once work has commenced, no refunds are available.

6. General Terms

6.1 All services provided by Imajique are subject to these Terms & Conditions unless otherwise agreed in writing.

6.2 Any modifications or additional agreements must be documented in writing and signed by both parties.

6.3 Continued use of Imajique services indicates acceptance of these terms.
